The Long Walk to Freedom for 774 LGAs in Nigeria, by Emmanuella and Kayode
Nigeria’s 774 local government areas (LGAs) have long struggled under the weight of overbearing state governors accused of mismanaging funds meant for local administration. This interference has significantly hampered the efficiency of the third tier of government.
In recent months, the clamour for local government autonomy has reached a fever pitch, garnering the crucial support of President Bola Tinubu. In a significant turn of events, the Federal Government, represented by Attorney-General of the Federation (AGF) Lateef Fagbemi, took a bold step by suing the 36 state governors over alleged misconduct involving local government funds.
Currently, the Revenue Mobilisation Allocation and Fiscal Commission (RMAFC), operating under the Presidency, allocates the country’s monthly revenue as follows: the Federal Government receives 52.68%, states receive 26.72%, and LGAs receive 20.60%. Despite this, LGA funds are paid into a joint account operated by state and local governments.
The AGF’s lawsuit sought an order preventing governors from arbitrarily dissolving democratically elected councils. The suit was based on 27 grounds, including safeguarding the constitution and ensuring financial autonomy for local governments. The 36 state governors opposed the suit.
The Verdict
In his landmark judgement, Justice Emmanuel Agim affirmed the AGF’s right to institute the suit to protect the constitution. The Supreme Court directed that local government allocations from the Federation Account be paid directly to the local governments, bypassing state government coffers.
Justice Agim emphasised that state governors’ retention of LGA funds has disrupted local government operations. He ordered immediate compliance with the judgement, ensuring that no state government should receive funds intended for local governments.
This ruling marks a significant step towards financial autonomy and improved governance for Nigeria’s local government areas, reinforcing their ability to manage their affairs and serve their communities effectively.
