The Federal High Court in Abuja has directed Nnamdi Kanu, leader of the Biafra separatist movement, to open his defence in the terrorism charges brought against him by the federal government. Justice James Omotosho ruled that Kanu must present his defence without fail on Friday, October 24, or risk waiving his right to do so.

Kanu, who has chosen to represent himself, requested a three-month adjournment to prepare his defence, but the judge denied the request, emphasizing that the trial is on an accelerated schedule and cannot accommodate lengthy delays.

Throughout the hearing, Kanu challenged the court’s jurisdiction, citing four jurisdictional defects, alleged contempt by the federal government of a Court of Appeal ruling, and claimed he was being tried under a repealed law. He also raised concerns over denial of proper consultation with his lawyers during his custody, and questioned the authenticity of the medical report declaring him fit for trial.

Justice Omotosho dismissed these preliminary objections for the moment, stating that the court order for Kanu to open his defence remains in force. The judge noted that Kanu may still raise these issues in his final written submissions.

A Senior Advocate, Dr Onyechi Ikpeazu, appealed for an adjournment on behalf of Kanu to allow him time to prepare, but the judge reiterated that only Kanu himself can make such an application. Kanu maintained he needed more time due to the gravity of the case and the need to gather witnesses.

Ultimately, the court insisted that Kanu must begin his defence on October 24 without further delay.
