Akpabio Appeals Court Ruling Reinstating Senator Natasha Akpoti-Uduaghan
Nigerian Senate President, Godswill Akpabio has filed an appeal at the Court of Appeal challenging a recent ruling by the Federal High Court in Abuja, which ordered the reinstatement of Senator Natasha Akpoti-Uduaghan to the Senate. The lower court had earlier nullified her suspension, citing procedural irregularities and a violation of her constitutional rights.
Akpabio’s legal team, in a notice of appeal, argues that the Senate acted within its constitutional authority in disciplining its members and that the judiciary lacks the jurisdiction to interfere in the internal affairs of the legislative arm. The appeal specifically contests the Federal High Court’s ruling on the grounds of separation of powers and the autonomy of the legislature in regulating its own conduct.
The Senate President maintains that Senator Akpoti-Uduaghan’s suspension was a result of internal disciplinary measures properly undertaken according to Senate rules. His legal team also disputes the court’s interpretation of due process in the context of parliamentary proceedings, warning that the judgment, if upheld, could set a dangerous precedent for judicial intrusion into legislative functions.
The case has sparked national attention, with many viewing it as a pivotal test of Nigeria’s constitutional balance between the branches of government. Akpoti-Uduaghan, who represents Kogi Central Senatorial District, has described her suspension as politically motivated and her reinstatement as a victory for democratic accountability and the rule of law.
Despite her return to the Senate chamber following the Federal High Court’s decision, the ongoing appeal suggests that the final outcome remains uncertain. Legal analysts say the case could have far-reaching implications for how internal legislative matters are handled and reviewed by the judiciary going forward.
