Harvey Weinstein, the disgraced film mogul, made a courtroom appearance in New York on Wednesday, marking his first time facing the legal system since his convictions for rape and sexual assault were overturned in the state.

Arriving at the Manhattan courtroom, Weinstein, appearing noticeably frail, was wheeled in on a wheelchair, accompanied by his legal team. Despite his condition, he smiled and waved at supporters as he was pushed past the public gallery.

Prosecutors, addressing the court, emphasized their commitment to pursuing justice in the case. They noted the presence of Jessica Mann, one of Weinstein’s accusers, and expressed confidence in securing a conviction once again. “We believe in this case… to that end (accuser) Jessica Mann is in court today,” one prosecutor stated. “She is committed to seeing justice served once again. We have every belief that the defendant will be convicted again at trial.”

Although it was anticipated that the judge would vacate Weinstein’s convictions in New York, he was not expected to be released due to a separate conviction in California that remained unchanged.

Weinstein’s original convictions in New York, dating back to 2020, were for the rape and sexual assault of actress Jessica Mann in 2013, as well as the forcible performance of oral sex on former production assistant Mimi Haley in 2006. These convictions resulted in a lengthy prison sentence of 23 years.

However, last week, the highest court in New York ruled that the trial judge had made an error by admitting testimony from women who claimed abuse by Weinstein but were not named in the charges against him. As a result, the office of Manhattan’s district attorney indicated its intention to seek a retrial, affirming its commitment to supporting survivors of sexual assault.

Arthur Aidala, head of Weinstein’s legal team, reiterated their stance that even “unpopular” individuals deserve a fair trial. He asserted, “We knew that Harvey Weinstein did not get a fair trial.”

Weinstein, who remains in custody due to a separate rape conviction in California, where he was sentenced to 16 years, has faced a myriad of health issues during his time in prison, including periods of hospitalization in a secure medical unit.
