BREAKING: Court halts reinstatement of Emir Sanusi
In Kano, a Federal High Court has issued an ex-parte order preventing Governor Abba Kabir Yusuf from reinstating Emir Muhammadu Sanusi II until a final decision is made in the ongoing lawsuit.
The court order also opposes the dissolution of the emirates of Bichi, Gaya, Karaye, and Rano. This action follows the State House of Assembly’s approval of a bill that led to the attempted reinstatement.
The court has ordered all parties involved to maintain the current situation until the lawsuit filed by Sarkin Dawaki Babba and Aminu Babba-Dan Agundi is resolved.
Justice A.M. Liman of the Federal High Court has allowed the Plaintiff Applicant to serve their legal documents on the 6th Defendant (IGP) in FCT Abuja and beyond the court’s jurisdiction.
The defendants in this case include the Kano State Government, Kano State House of Assembly, Speaker of the State Assembly, Kano State Commissioner of Police, Inspector General of Police, Nigerian Security and Civil Defence Corps, and Department of State Services.
Justice Liman has directed that due to the constitutional and jurisdictional issues raised in the application, both parties must present their arguments in court during the hearing of the Fundamental Rights application scheduled for June 3, 2024.
To ensure peace and security within the state, an interim injunction has been granted by the court to prevent the Respondents from enforcing the Kano State Emirate Law Council (Repeal) Law.
Both parties are instructed to maintain the status quo that existed before the bill was passed and assented to until the Fundamental Rights application is heard.
The case has been adjourned to June 3, 2024. Governor Abba Yusuf announced Emir Sanusi’s re-appointment on Thursday.
