Court Bars Kano APC Ward Executives from Dismissing Ganduje

A Federal High Court in Kano, presided over by Justice A. M. Liman, has issued a restraining order against the purported executive members of the All Progressives Congress (APC) Ganduje Ward from suspending the party’s national chairman, Abdullahi Ganduje. The order is pending the hearing and determination of a suit filed by the former governor, seeking the enforcement of his fundamental rights.

Ganduje, represented by his counsel, Barrister Hadiza Nasir Ahmed, approached the court seeking the enforcement of his rights to fair hearing and freedom of association, as provided for in the Enforcement and Procedure Rules, 2009, under Section 46 of the Constitution of the Federal Republic of Nigeria, 1999 as amended.

The order was granted following an ex parte application moved by Ganduje’s lawyer.

Furthermore, the presiding judge instructed all parties involved in the suit to maintain the status quo before the alleged emergency meeting of the APC Ganduje Ward executive members and to refrain from taking any action regarding the matter until the hearing and determination of the motion on notice.

The judge’s directive included restraining the respondents, including Basiru Nuhu Isah, the Nigeria Police Force, the Commissioner of Police, Kano Command, the Inspector General of Police, and the Department of State Service, from implementing or enforcing any decisions made during the purported emergency meeting held on April 20, 2024, pending the hearing and determination of the substantive application for the enforcement of the applicant’s fundamental rights.
